1. Acceptance of Terms
By accessing and using Ping.Africa services, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use our services.
2. Description of Service
Ping.Africa provides communication infrastructure services including SMS, WhatsApp Business API, cloud infrastructure, and VPN solutions. We reserve the right to modify, suspend, or discontinue any aspect of the services at any time.
3. Account Registration
To use our services, you must:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use of your account
- Be at least 18 years old or have parental consent
4. Acceptable Use Policy
You agree not to use our services to:
- Send spam or unsolicited messages
- Violate any laws or regulations
- Infringe on intellectual property rights
- Distribute malware or harmful code
- Engage in fraudulent activities
- Harass, threaten, or abuse others
- Attempt to gain unauthorized access to our systems
5. Payment and Billing
You agree to pay all fees associated with your use of our services. Payment terms include:
- All fees are non-refundable unless otherwise stated
- You must provide valid payment information
- Prices may change with 30 days notice
- Late payments may result in service suspension
- You are responsible for all applicable taxes
6. Service Level Agreement
We strive to maintain 99.9% uptime for our services. In the event of service interruption, we will make reasonable efforts to restore service as quickly as possible. Credits for downtime may be available under certain circumstances as outlined in our SLA documentation.
7. Data and Privacy
Your use of our services is also governed by our Privacy Policy. We implement appropriate security measures to protect your data, but cannot guarantee absolute security. You are responsible for maintaining backups of your data.
8. Intellectual Property
All content, features, and functionality of our services are owned by Ping.Africa and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our permission.
9. Limitation of Liability
To the maximum extent permitted by law, Ping.Africa shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services.
10. Indemnification
You agree to indemnify and hold Ping.Africa harmless from any claims, losses, damages, liabilities, and expenses arising from your use of our services or violation of these terms.
11. Termination
We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these terms. Upon termination, your right to use the services will immediately cease.
12. Modifications to Terms
We reserve the right to modify these terms at any time. We will notify you of significant changes via email or through our services. Your continued use after such modifications constitutes acceptance of the updated terms.
13. Governing Law
These terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.
